Is that legal?

It was about five years ago that I started seriously looking at doing Street Photography after learning what Street Photography is and noticing that that is what I'd been doing all my life.  This is one of those taken then.  

 I only keep or share what I consider to be the best of them, and though I took several scores of photos I only have about a dozen to show for it.  

 This one was taken on the Salt Lake City, Utah TRAX train.  After I snapped his photo he made a comment asking if it was legal for me to take his photo.  I told him that it is as long as it's in a public place.
